By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, please do not use our Services.
1. Acceptance of Terms
1.1. By registering for, enrolling in, accessing, or using any of our Services, you signify your unreserved acceptance of these Terms.
1.2. These Terms apply to all users of the Services, including, without limitation, users who are browsers, customers, merchants, and/ or contributors of content.
1.3. We reserve the right to update, change, or replace any part of these Terms by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
2. Services Offered
2.1. ProTuitions provides live, personalized online tutoring and educational programs for students from Kindergarten to Graduation. Our services include:
- KG to Class 8: Comprehensive tutoring across all core subjects.
- Class 9 to Graduation: Specialized tutoring in Commerce subjects (Accountancy, Business Studies, Economics, Commercial Studies).
- Spoken Hindi & Spoken English Classes.
- Crash Course & Test Preparations for various academic levels.
- All Services are delivered online via virtual classroom platforms.
- The specific details, curriculum, duration, and pricing of each program will be provided to you during the consultation and before enrollment.
3. Eligibility and Registration
3.1. To access our Services, you must be 15 years of age or older, or if you are under 15, you must have the permission and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
3.2. When you register for our Services, you agree to provide current, complete, and accurate information as prompted by the registration forms.
3.3. ProTuitions reserves the right to refuse service to anyone for any reason at any time.
4. Payment, Fees, and Refund Policy
4.1. Fees: All fees for Services are clearly outlined during your consultation and confirmed upon enrollment. Fees are typically charged per session, package, course, month, or as agreed.
4.2. Payment: Payments must be made in advance as per the agreed schedule. We accept bank transfers and UPI payments.
4.3. Refund Policy:
- No Refunds for Completed Sessions: Fees paid for sessions that have already been delivered are non-refundable.
- Refunds for Unused Sessions/Packages: For fees paid in advance for a package or set of sessions, a partial refund for the unused portion may be considered on a case-by-case basis, subject to a reasonable administrative fee. The administrative fee will be clearly communicated if applicable.
- Cancellation by ProTuitions: If ProTuitions cancels a program or session for which you have paid, we will offer a full refund for that specific service or an alternative arrangement mutually agreed upon.
- Requests: All refund requests must be submitted in writing to contact@protuitions.com and will be processed within 10 business days.
4.4. Fee Changes: ProTuitions reserves the right to change its fees for Services at any time, though any changes will not apply to existing enrolled programs unless specifically agreed upon by both parties.
5. Scheduling, Attendance, and Cancellations
5.1. Scheduling: Sessions will be scheduled at mutually agreed-upon times between the client and ProTuitions.
5.2. Student Attendance: It is the student’s responsibility to attend scheduled sessions on time. No refunds or make-up sessions will be provided for student no-shows or late arrivals.
5.3. Student Cancellations/Rescheduling:
- Clients must notify ProTuitions at least 24 hours in advance to cancel or reschedule a session.
- Failure to provide 24 hours’ notice may result in the session being charged at its full rate.
- Excessive cancellations or rescheduling may lead to a review of the student’s enrollment.
5.4. ProTuitions/Tutor Cancellations:
- In the rare event that a tutor needs to cancel or reschedule, ProTuitions will provide as much notice as possible.
- A make-up session will be arranged, or a credit will be issued for the missed session.
6. Student and Parent Conduct
6.1. Respectful Environment: All students and parents are expected to maintain a respectful, positive, and conducive learning environment. Disruptive, abusive, or inappropriate behavior towards tutors, staff, or other students will not be tolerated.
6.2. No Harassment: Harassment of any kind, including but not limited to verbal, physical, sexual, or emotional abuse, is strictly prohibited.
6.3. ProTuitions’ Right to Terminate: ProTuitions reserves the right to immediately terminate Services, without refund, for any student or parent who violates these conduct guidelines.
7. Intellectual Property
7.1. All content, materials, teaching methodologies, software, and intellectual property provided by ProTuitions (including but not limited to lesson plans, worksheets, presentations, recordings, website content, logos) are the exclusive property of ProTuitions or its licensors.
7.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without the prior written consent of ProTuitions.
7.3. Session recordings (if provided) are for the sole use of the enrolled student for review purposes and may not be shared, distributed, or uploaded to public platforms.
8. Privacy Policy
8.1. Your use of our Services is also governed by our Privacy Policy, which is incorporated herein by reference. 9. Disclaimer of Warranties; Limitation of Liability
9.1. ProTuitions strives to provide high-quality educational services, but we do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.
9.2. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
9.3. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
9.4. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall ProTuitions, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless ProTuitions and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
11. Governing Law and Jurisdiction
11.1. These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of West Bengal, India, without regard to its conflict of law principles.
11.2. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Kolkata, India.
12. Severability
12.1. In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms; such determination shall not affect the validity and enforceability of any other remaining provisions.
13. Entire Agreement
13.1. The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
13.2. These Terms and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
13.3. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
